Why in News

On 4 November 2026 the Union Ministry of Health and Family Welfare proposed amendments to the Drugs Rules, 1945, providing for immediate suspension of manufacturing licences for drugs declared Not of Standard Quality on specified critical quality parameters, and notified the draft for public consultation.

The Union Ministry of Health and Family Welfare has proposed amendments to the Drugs Rules, 1945, so that a manufacturing licence can be suspended straight away once a medicine is declared Not of Standard Quality (NSQ) on certain critical quality parameters. The proposal was made public on 4 November 2026.

The gap being closed

As the rules stand, a licence can be suspended or cancelled only after the prescribed procedure is followed, which includes issuing a show-cause notice. That leaves a stretch of time between the moment a drug is declared NSQ and the moment regulatory action begins, and during that stretch the medicine may stay in circulation. Recalling it later becomes harder, and patients remain exposed in the meantime.

The five critical parameters

Immediate suspension is proposed where a Government Analyst's report declares a drug NSQ on any of these:

  • Assay
  • Dissolution
  • Related Substances
  • Impurities
  • Sterility

The suspension would be ordered by the Central Licensing Approving Authority or the State Licensing Authority, whichever has jurisdiction. These parameters are treated as decisive for judging whether a medicine is of proper quality, which is why failures on them are to draw instant action.

How a suspended licence comes back

Revocation is not automatic. The suspension continues until the manufacturer carries out an effective Root Cause Analysis to establish why the quality failure happened and then puts in place Corrective and Preventive Action (CAPA) to the satisfaction of the Licensing Authority. Only after those measures are in place and verified by the authority can the suspension be lifted. The design is meant to ensure that the defect is actually fixed rather than merely explained.

Wider reporting through Form 13

A consequential change is proposed in Form 13, the Government Analyst's test report. Under the new arrangement the report would be endorsed to the Drugs Controller General of India, to the State or Union Territory Licensing Authority in whose jurisdiction the manufacturing site falls, and to both the manufacturer and the marketer of the drug. Sending the finding to all of them at once is intended to speed up coordinated action and spread accountability across the manufacturing and marketing chain.

Where the proposal came from

The amendments follow deliberations at the 65th meeting of the Drugs Consultative Committee, held on 20 December 2024, and the recommendations of the 92nd meeting of the Drugs Technical Advisory Board, held on 24 April 2025. The draft has been notified for public consultation, and objections and suggestions may be sent within 30 days from the date on which copies of the Gazette of India carrying the draft rules are made available to the public.

Frequently Asked Questions

What does NSQ mean in drug regulation?

NSQ stands for Not of Standard Quality. A drug is declared NSQ in the test report of a Government Analyst, and the proposed amendments to the Drugs Rules, 1945, would allow its manufacturing licence to be suspended at once on specified critical parameters.

On which parameters would a licence be suspended immediately?

On Assay, Dissolution, Related Substances, Impurities or Sterility. A failure on any of these in the Government Analyst's report would invite immediate suspension by the Central Licensing Approving Authority or the State Licensing Authority.

How can a suspended licence be restored?

The suspension continues until the manufacturer completes an effective Root Cause Analysis and implements Corrective and Preventive Action to the satisfaction of the Licensing Authority. Revocation is allowed only after the authority verifies those measures.

Which committees recommended these changes?

The amendments follow deliberations at the 65th meeting of the Drugs Consultative Committee, held on 20 December 2024, and the recommendations of the 92nd meeting of the Drugs Technical Advisory Board, held on 24 April 2025.
