Which of the following statements is/are true of the Fundamental Duties of an Indian citizen ? 1. A legislative process has been provided to enforce these duties. 2. They are correlative to legal duties. Select the correct answer using the code given below :

  1. A.1 only
  2. B.2 only
  3. C.Both 1 and 2
  4. D.Neither 1 nor 2

Correct answer

D. Neither 1 nor 2

Explanation

The correct answer is D, Neither 1 nor 2. The Fundamental Duties are moral obligations that the Constitution itself does not enforce, and they are not the legal counterpart of any right.

The duties were added by the 42nd Amendment in 1976 on the advice of the Swaran Singh Committee and placed in Part IV-A, Article 51A; the 86th Amendment in 2002 added the eleventh, a parent's duty to give a child aged 6 to 14 a chance of education. The Constitution provides no machinery or legislative process to enforce them, and they are non-justiciable: a court cannot order a citizen to perform them. Parliament may give effect to some of them through separate laws, such as laws against insulting the national flag, but that is a matter of ordinary legislation, not a process built into the duties.

A and C are wrong: no legislative process for enforcement is provided.

B is wrong: the duties are moral civic duties, not correlatives of legal duties.

Exam tip: Fundamental Duties = Article 51A, Part IV-A, 42nd Amendment 1976 (10 duties), 86th Amendment 2002 (11th); non-justiciable.
