Statement I : In India, a majority of the members of the Rajya Sabha are elected by the elected members of the State Legislatures. Statement II : Members of the Rajya Sabha elected by the State Legislative Assemblies need to have their domicile in the concerned State.

  1. A.Both the statements are individually true and Statement II is the correct explanation of Statement I
  2. B.Both the statements are individually true but Statement II is not the correct explanation of Statement I
  3. C.Statement I is true but Statement II is false
  4. D.Statement I is false but Statement II is true

Correct answer

C. Statement I is true but Statement II is false

Explanation

The correct answer is C, Statement I is true but Statement II is false. Most Rajya Sabha members are chosen by MLAs, but no domicile is needed.

Under Article 80, the Rajya Sabha can have at most 250 members: 12 nominated by the President and up to 238 representatives of the States and Union Territories. The State representatives are elected by the elected members of each State Legislative Assembly by proportional representation through the single transferable vote, so they form a clear majority of the House. Earlier the Representation of the People Act, 1951 required a candidate to be an elector in the State he sought to represent. The 2003 amendment removed this domicile condition, so a candidate now only has to be an elector somewhere in India. The Supreme Court upheld the change in Kuldip Nayar v. Union of India (2006).

A and B are wrong: they treat Statement II as true, but the domicile rule no longer exists.

D is wrong: Statement I is true, as elected State representatives far outnumber nominated members.

Exam tip: Rajya Sabha, Article 80, maximum 250 (238 elected + 12 nominated); domicile rule dropped in 2003, upheld in Kuldip Nayar (2006).
