With reference to the Speaker of the Lok Sabha, consider the following statements : While any resolution for the removal of the Speaker of the Lok Sabha is under consideration 1. He/She shall not preside. 2. He/She shall not have the right to speak. 3. He/She shall not be entitled to vote on the resolution in the first instance. Which of the statements given above is/are correct?

  1. A.1 only
  2. B.1 and 2 only
  3. C.2 and 3 only
  4. D.1, 2 and 3

Correct answer

A. 1 only

Explanation

The correct answer is A, 1 only. Article 96 of the Constitution sets out the Speaker's position while a resolution for his or her removal is being considered. Under Article 96(1), the Speaker shall not preside at such a sitting, even though present, so statement 1 is correct. Under Article 96(2), the Speaker has the right to speak in, and otherwise take part in, the proceedings of the House, so statement 2 is wrong. The same clause says the Speaker is entitled to vote only in the first instance on that resolution or any other matter during those proceedings, but not in the case of an equality of votes; the casting vote is lost. So statement 3, which denies the first-instance vote, is wrong. The removal itself needs a majority of all the then members, after 14 days' notice (Article 94). Option B is wrong because statement 2 is false. Option C is wrong because statements 2 and 3 are false. Option D is wrong because only statement 1 holds. Exam tip: during a removal motion the Speaker cannot preside, but can speak and vote in the first instance, without a casting vote.
