Indian PolityMediumAsked in: UPSC Civil Services · CSE Prelims 2025, GS Paper I

With reference to the Indian polity, consider the following statements : I. The Governor of a State is not answerable to any court for the exercise and performance of the powers and duties of his/her office. II. No criminal proceedings shall be instituted or continued against the Governor during his/her term of office. III. Members of a State Legislature are not liable to any proceedings in any court in respect of anything said within the House. Which of the statements given above are correct?

  1. A.I and II only
  2. B.II and III only
  3. C.I and III only
  4. D.I, II and III

Correct answer

D. I, II and III

Explanation

The correct answer is D, I, II and III. Article 361 protects the Governor in both ways described, and Article 194 protects what legislators say in the House.

Under Article 361(1), the President and the Governor of a State are not answerable to any court for the exercise of the powers and duties of their office. Article 361(2) adds that no criminal proceedings may be started or continued against them in any court during their term, and Article 361(3) bars their arrest or imprisonment during that time. For State Legislatures, Article 194(2) says that no member is liable to any proceedings in any court for anything said or any vote given in the Legislature or its committees; Article 105 gives the same privilege to Members of Parliament.

A is wrong because it leaves out III. B is wrong because it leaves out I. C is wrong because it leaves out II; all three statements are correct.

Exam tip: Article 361 = immunity of President and Governor; Articles 105 and 194 = freedom of speech in Parliament and State Legislatures.
