With reference to the Indian Parliament, consider the following statements : 1. A bill pending in the Lok Sabha lapses on its dissolution. 2. A bill passed by the Lok Sabha and pending in the Rajya Sabha lapses on the dissolution of the Lok Sabha. 3. A bill in regard to which the President of India notified his/her intention to summon the Houses to a joint sitting lapses on the dissolution of the Lok Sabha. Which of the statements given above is/are correct ?

  1. A.1 only
  2. B.1 and 2
  3. C.2 and 3
  4. D.3 only

Correct answer

B. 1 and 2

Explanation

The correct answer is B, 1 and 2. Article 107 of the Constitution decides which bills die when the Lok Sabha is dissolved. A bill pending in the Lok Sabha lapses on its dissolution, whether it began there or came from the Rajya Sabha, so statement 1 is correct. A bill passed by the Lok Sabha and pending in the Rajya Sabha also lapses, so statement 2 is correct. Statement 3 is wrong: under Article 108(5), a joint sitting may be held even after the Lok Sabha is dissolved if the President notified the intention to summon it before the dissolution, so such a bill does not lapse. Other bills that survive are a bill pending in the Rajya Sabha that the Lok Sabha has not passed, and a bill passed by both Houses and awaiting the President's assent. Option A is wrong because it leaves out statement 2. Option C is wrong because statement 3 is false. Option D is wrong because statement 3 is the only incorrect one. Exam tip: bills that reach the Lok Sabha's hands die with it; Rajya Sabha-only bills, joint-sitting bills and bills awaiting assent survive.
