Indian PolityMediumAsked in: UPSC Civil Services · CSE Prelims 2021, GS Paper I

With reference to India, consider the following statements : 1. Judicial custody means an accused is in the custody of the concerned magistrate and such accused is locked up in police station, not in jail. 2. During judicial custody, the police officer in charge of the case is not allowed to interrogate the suspect without the approval of the court. Which of the statements given above is/are correct?

  1. A.1 only
  2. B.2 only
  3. C.Both 1 and 2
  4. D.Neither 1 nor 2

Correct answer

B. 2 only

Explanation

The correct answer is B, 2 only. In judicial custody the accused is held in jail, not in a police lock-up, and the police need the court's leave to question them. After an arrest the police must produce the accused before a magistrate within 24 hours. The magistrate may then send the person to police custody, where they stay in the police station lock-up and can be questioned by the investigating officer, or to judicial custody, where they are kept in jail under the magistrate's authority. Statement 1 is wrong because it places a person in judicial custody in the police station, which describes police custody instead. Statement 2 is correct: once the accused is in judicial custody, the officer in charge of the case cannot interrogate them without the court's permission. This safeguard protects the accused from coercion. Option A is wrong because statement 1 is false. Option C is wrong because it accepts statement 1. Option D is wrong because statement 2 is true. Exam tip: police custody = lock-up and police questioning; judicial custody = jail, questioning only with the court's permission.
