Which one of the following is included in Article 51A (Part IV A) of the Constitution of India?

  1. A.Fundamental Duties
  2. B.Suspension of Fundamental Rights
  3. C.Special Powers of Governors
  4. D.Writs

Correct answer

A. Fundamental Duties

Explanation

The correct answer is A, Fundamental Duties. Article 51A, the only article in Part IV-A, lists the Fundamental Duties of every citizen of India.

The Fundamental Duties were added by the 42nd Amendment of 1976 on the recommendation of the Swaran Singh Committee, and the idea was borrowed from the Constitution of the former USSR. Ten duties were added at first. The 86th Amendment of 2002 added the eleventh, making a parent or guardian responsible for providing opportunities for education to a child between 6 and 14 years. The duties include respecting the Constitution, the National Flag and the National Anthem, protecting the environment and developing a scientific temper. They are not enforceable in court.

B is wrong: the suspension of Fundamental Rights during an emergency is covered by Articles 358 and 359 in Part XVIII. C is wrong: special responsibilities of Governors are found in Articles 371 to 371J in Part XXI. D is wrong: writs are issued by the Supreme Court under Article 32 and by High Courts under Article 226.

Exam tip: Part IV-A, Article 51A, 42nd Amendment (1976), Swaran Singh Committee; 11th duty added by the 86th Amendment (2002).
