Correct answer
Explanation
The correct answer is C, Both 1 and 2. The Indian Penal Code was drafted on the recommendation of the First Law Commission, and the Bharatiya Nyaya Sanhita, 2023 repealed and replaced it.
The First Law Commission was set up in 1834 under the Charter Act of 1833, with Thomas Babington Macaulay as its chairman. It prepared the draft of the penal code in 1837. The draft was revised over the years and enacted as the Indian Penal Code in 1860, coming into force on 1 January 1862. In 2023 Parliament passed three new criminal laws: the Bharatiya Nyaya Sanhita in place of the IPC, the Bharatiya Nagarik Suraksha Sanhita in place of the Code of Criminal Procedure, and the Bharatiya Sakshya Adhiniyam in place of the Indian Evidence Act. All three came into force on 1 July 2024.
Option A is wrong because statement 2 is also true. Option B is wrong because statement 1 is true. Option D is wrong because both statements are correct.
Exam tip: First Law Commission 1834 (Macaulay) drafted the IPC; IPC 1860 replaced by BNS from 1 July 2024.
