Consider the following statements with regard to pardoning power of the President of India : I. The exercise of this power by the President can be subjected to limited judicial review. II. The President can exercise this power without the advice of the Central Government. Which of the statements given above is/are correct?

  1. A.I only
  2. B.II only
  3. C.Both I and II
  4. D.Neither I nor II

Correct answer

A. I only

Explanation

The correct answer is A, I only. Courts can review a pardon on limited grounds, but the President always acts on the advice of the Union Council of Ministers.

Article 72 lets the President grant pardons, reprieves, respites, remissions and commutations, including in death sentences and court-martial cases. In Maru Ram (1980) and Kehar Singh (1989) the Supreme Court held that the power is exercised on the advice of the Union government, as Article 74 requires. In Epuru Sudhakar (2006) it held that a pardon can be struck down if it was granted without applying the mind, on irrelevant or extraneous grounds, for political reasons or with mala fides. The merits of the decision are not reviewed, which is why the review is called limited.

B is wrong because the President cannot act alone on a mercy petition. C is wrong because statement II is false. D is wrong because statement I is true.

Exam tip: Article 72, President on Cabinet advice; Article 161, Governor; limited review since Epuru Sudhakar, 2006.
