Why in News

On 29 October 2026 the Ministry of Labour and Employment announced that ESIC has extended the New Amnesty Scheme, 2025 for a further three months, from 1 October 2026 to 31 December 2026, on the same terms, giving employers and insured persons more time to settle pending cases out of court.

Employers caught in long-running insurance litigation were given more breathing room on 29 October 2026, when the Ministry of Labour and Employment said that the Employees' State Insurance Corporation (ESIC) had stretched its amnesty window by three months. The offer, known formally as the New Amnesty Scheme, 2025, opened on 1 October 2025 and had been due to shut on 30 September 2026. It will now stay available from 1 October 2026 through 31 December 2026, and every condition attached to it stays exactly as it was. The Corporation took the step after going through representations that reached it from a range of stakeholders.

What the scheme sets out to do

The amnesty is a single, time-bound route out of the courtroom. Years of demands raised under the earlier ESI law left a heavy pile of matters pending before courts, and each of them consumes the time of the Corporation as much as of the employer. Instead of letting every such dispute run its full course, ESIC offers a defined procedure by which an employer can settle with it outside court. The wider purpose is to bring down the volume of litigation and to draw employers towards paying willingly rather than contesting.

The three reliefs on offer

  • Where a demand rests on an ad-hoc assessment, the employer may close it by paying the contribution genuinely owed together with the interest on it, and no damages are charged at all.
  • Where the dues stand cleared but a case is still alive, it can be taken off the file once the employer parts with a tenth of the damages under dispute.
  • Where the Corporation went to court because records were not furnished or payment arrived late, and the employer has since fallen in line, the case is withdrawn with the court's permission.

Who may apply

Eligibility turns on the date the litigation began. Only court cases instituted up to 31 March 2025 come within the scheme; anything filed after that cut-off remains outside it and must travel the ordinary legal road. Fixing the date this way keeps the measure a one-time clearing of old matters rather than a standing concession.

Why the extra three months matter

With the window pushed back, eligible employers and insured persons have further time to come forward and use the benefits. The government describes the route as a practical and employer-friendly one that sits with its broader aim of making business easier to do, while still protecting the entitlements of the citizens that ESIC serves. Stakeholders have been urged to act well before the scheme closes on 31 December 2026, since no further extension has been announced.

Frequently Asked Questions

Till when is the ESIC New Amnesty Scheme 2025 now open?

Till 31 December 2026. The scheme ran from 1 October 2025 to 30 September 2026 and has been extended by three months, covering 1 October 2026 to 31 December 2026 on the same terms and conditions.

Which cases are eligible under the New Amnesty Scheme, 2025?

Court cases filed up to 31 March 2025 under the erstwhile ESI Act. Cases instituted after that date fall outside the scheme and follow the normal legal process.
