Consider the following statements with reference to the Constitution of India : 1. There is no Article in the Constitution of India that specifies that the Constitution of India will be officially called the 'Constitution of India'. 2. There is no Article in the Constitution of India that specifies that the Indian Independence Act, 1947 and the Government of India Act, 1935 stand repealed. 3. There is no Article in the Constitution of India that mentions 26th January, 1950 as the date of the commencement of the Constitution of India. Which one of the following conclusions based on the above statements is correct ?

  1. A.All three statements are correct.
  2. B.There is no correct statement.
  3. C.There are two correct statements that include statement 3.
  4. D.There is only one correct statement.

Correct answer

B. There is no correct statement.

Explanation

The correct answer is B, There is no correct statement. Each of the three matters is covered by an Article in Part XXII of the Constitution, so all three statements are false.

Part XXII holds the closing provisions. Article 393 gives the short title: "This Constitution may be called the Constitution of India." Article 394 deals with commencement: it says that a few provisions, such as those on citizenship, elections and provisional Parliament, came into force at once on 26 November 1949, and the rest on the twenty-sixth day of January, 1950, which the Constitution calls its commencement. Article 395 repeals the Indian Independence Act, 1947 and the Government of India Act, 1935, along with the enactments amending them, though not the Abolition of Privy Council Jurisdiction Act, 1949.

Statement 1 is wrong because of Article 393, statement 2 because of Article 395 and statement 3 because of Article 394. So A, C and D, which treat one or more statements as correct, are all wrong.

Exam tip: Part XXII: Article 393 short title, 394 commencement (26 January 1950), 395 repeals.
