Consider the following statements : I. On the dissolution of the House of the People, the Speaker shall not vacate his/her office until immediately before the first meeting of the House of the People after the dissolution. II. According to the provisions of the Constitution of India, a Member of the House of the People on being elected as Speaker shall resign his/her political party immediately. III. The Speaker of the House of the People may be removed from his/her office by a resolution of the House of the People passed by a majority of all the then Members of the House, provided that no resolution shall be moved unless at least fourteen days' notice has been given of the intention to move the resolution. Which of the statements given above are correct?

  1. A.I and II only
  2. B.II and III only
  3. C.I and III only
  4. D.I, II and III

Correct answer

C. I and III only

Explanation

The correct answer is C, I and III only. Both come word for word from Article 94, while the Constitution says nothing about the Speaker leaving his or her party.

Article 94 deals with the vacation, resignation and removal of the Speaker and Deputy Speaker. Its proviso keeps the Speaker in office after the Lok Sabha is dissolved until just before the new House first meets, so the office is never vacant. Clause (c) allows removal by a resolution passed by a majority of all the then members of the House, an effective majority, after at least 14 days' notice. While such a resolution is under consideration the Speaker does not preside, though he or she may speak and vote in the first instance, as Article 96 provides.

A is wrong because statement II is false: resigning from the party is only a convention followed in some countries such as Britain, not a constitutional rule in India. B is wrong because it includes statement II and drops statement I. D is wrong because statement II is false.

Exam tip: Article 94: Speaker stays until the new House meets; removal by effective majority after 14 days' notice.
