Consider the following statements : 1. As per recent amendment to the Indian Forest Act, 1927, forest dwellers have the right to fell the bamboos grown on forest areas. 2. As per the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006, bamboo is a minor forest produce. 3. The Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 allows ownership of minor forest produce to forest dwellers. Which of the statements given above is/are correct?

  1. A.1 and 2 only
  2. B.2 and 3 only
  3. C.3 only
  4. D.1, 2 and 3

Correct answer

B. 2 and 3 only

Explanation

The correct answer is B, 2 and 3 only. The Forest Rights Act names bamboo as minor forest produce and gives forest dwellers ownership of such produce, but the Indian Forest Act amendment did not allow felling of bamboo grown in forest areas.

The Indian Forest (Amendment) Act, 2017 removed bamboo grown in non-forest areas, such as farms and private land, from the definition of "tree". This freed farmers to grow, cut and transport such bamboo without a felling permit. Bamboo growing inside forest areas still remains regulated. The Forest Rights Act, 2006 defines minor forest produce to include all non-timber produce of plant origin, and it names bamboo, brushwood, tendu leaves, honey, lac and medicinal plants. Under Section 3(1)(c), forest dwellers get the right of ownership, access to collect, use and dispose of minor forest produce gathered traditionally.

A is wrong because statement 1 is incorrect. C is wrong because statement 2 is also correct. D is wrong because statement 1 is incorrect.

Exam tip: 2017 amendment = bamboo on non-forest land is not a "tree"; FRA 2006 = bamboo is minor forest produce.
